• No information provided by Just Metrics constitutes legal advice
• Using the Service does not establish an attorney-client relationship with Just Metrics, its operators, or anyone associated with the Service
• Nothing you enter into Just Metrics is protected by attorney-client privilege vis-à-vis Just Metrics
• Any information supplied by Just Metrics is intended solely as general guidance and statistical analysis
• You should consult with a qualified attorney for legal advice specific to your situation

If you need legal advice, consult a licensed attorney in your jurisdiction.

2. Data Accuracy Disclaimer — Use at Your Own Risk

Source Data Limitations

Our federal sentencing database is derived from multiple public sources including but not limited to data from:

• U.S. Sentencing Commission
• Federal Judicial Center
• Public Access to Court Electronic Records (PACER)
• Free Law Project

• Source data may contain errors, inconsistencies, or incomplete information
• Data entry errors may exist in the underlying source materials
• Statistical coding and classification systems may change over time
• Not all sentencing data may be publicly available or included in our database
• We do not control or verify the accuracy of data from these third-party sources

Analysis Limitations

• Our analysis tools provide statistical comparisons and trends, not predictions
• Past sentencing patterns do not guarantee future outcomes
• Every case is unique and depends on facts, circumstances, and individual judicial discretion
• Our algorithms and calculations may contain errors or produce unexpected results
• Report generation may fail or produce incomplete results

PACER Data and Links

• We provide links to PACER (Public Access to Court Electronic Records) for reference purposes
• PACER data is maintained by federal courts, not by Just Metrics
• We do not control or verify the accuracy of PACER data
• Links to PACER may become broken or outdated
• Case information obtained from PACER may be incomplete, sealed, redacted, or superseded

Your Responsibility

You acknowledge and agree that:

• You use all data, analysis, and reports from Just Metrics entirely at your own risk
• You are solely responsible for verifying the accuracy of any information before relying on it
• You will independently verify all data points critical to your legal work
• Just Metrics shall not be liable for any decisions you make based on information from the Service

3. Prohibited Uses — FCRA Compliance

You expressly agree that you will NOT use Just Metrics or any information derived from the Service:

Prohibited Under FCRA

As a factor in establishing any individual's eligibility for:

• Credit or loans
• Insurance
• Employment
• Government benefits
• Housing or rental applications
• Or any other purpose specified in 15 U.S.C. § 1681b(a)

• To generate a "consumer report" as defined under FCRA (15 U.S.C. § 1681a(d))
• In any manner that could subject Just Metrics to FCRA obligations

Other Prohibited Uses

You will NOT use Just Metrics or information from the Service to:

• Harass, stalk, threaten, or intimidate any individual
• Invade anyone's privacy
• Conduct background checks for employment, tenant screening, or credit decisions
• Engage in identity theft or fraud
• Violate any individual's civil rights
• Further any criminal or illegal activity
• Violate any applicable international, national, federal, state, or local law

Public Records Notice

While our database may contain information about individuals involved in federal criminal cases, this information is derived from public court records. The inclusion of such information:

• Does not imply guilt or wrongdoing
• May be outdated, incomplete, or inaccurate
• Should not be used to make decisions about individuals
• Is provided solely for legal research and analysis purposes

4. Prohibited Data Extraction and Commercial Use

Absolute Prohibitions

You expressly agree that you will NOT:

• Scrape, harvest, or extract data from Just Metrics using automated tools, bots, scripts, or any other means
• Attempt to bypass rate limits or other safeguards that prevent abuse of unlimited report generation
• Resell, redistribute, or sublicense any data, reports, or analysis obtained from Just Metrics
• Create derivative databases or competing services using our data
• Use data mining, robots, or similar data gathering tools to extract content
• Reverse engineer our algorithms, methodologies, or data processing techniques
• Download or export large quantities of data for purposes other than your individual case work
• Share your account credentials to allow unauthorized access by others
• Circumvent technical measures we implement to prevent data extraction

Permitted Use

Just Metrics data and reports may ONLY be used for:

Virtually unlimited reports are subject to reasonable rate limits to prevent abuse.

Rate limits are designed to accommodate a single criminal defense attorney working on an active matter, and may restrict the number of materially distinct report requests within a given period.

• Sentencing advocacy in specific federal criminal cases
• Legal research directly related to federal sentencing
• Individual case analysis for cases you are working on
• Educational purposes related to federal sentencing law and practice

One User, One Use

• Your subscription is for your individual use only
• Reports generated are for your client matters only
• You may not provide access to Just Metrics to non-subscribers

Screenshots and Limited Copying

You may:

• Take reasonable screenshots of analysis for inclusion in court filings or client communications
• Print or save individual reports for specific cases you are handling

You may not:

• Systematically copy our entire database
• Create compilations of multiple reports for redistribution
• Use our data to build training datasets for AI/ML models without express written permission

Enforcement and Consequences

Violation of this section will result in:

1. Immediate account termination without refund
2. Legal action to enforce our intellectual property rights
3. Monetary damages including any profits derived from misuse of our data
4. Injunctive relief to prevent further unauthorized use
5. Recovery of attorney's fees and costs incurred in enforcement

We actively monitor for unauthorized data extraction and employ technical measures to detect and prevent scraping.

5. Disclaimer of Warranties

To the maximum extent permitted by law, Just Metrics disclaims all warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of any data or analysis
• Warranties of non-infringement of third-party intellectual property rights
• Warranties regarding uptime, availability, or uninterrupted service
• Warranties that the Service will be error-free or that defects will be corrected
• Warranties regarding the security of data transmission or storage

You acknowledge that:

• We may discontinue, alter, or restrict the Service at any time without notice
• We may experience delays, interruptions, errors, or omissions
• The Service may simply cease to exist
• Your data may be lost, corrupted, or become inaccessible

6. Limitation of Liability

No Liability for Damages

Just Metrics, its operators, directors, employees, contractors, and affiliates shall NOT be liable for any:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages from reliance on any information obtained through the Service
• Damages from unauthorized access to or alteration of your data
• Damages from any errors, omissions, or inaccuracies in data or analysis
• Damages from any legal claims, disputes, or adverse outcomes in cases where you used our Service

Your Assumption of Risk

You specifically acknowledge that:

• You use the Service entirely at your own risk
• The risk of injury, loss, or adverse outcomes rests entirely with you
• You are responsible for any consequences of relying on data from the Service
• You should independently verify all critical information

Maximum Liability Cap

In no event shall our total liability to you for all damages exceed the amount you paid to Just Metrics in the twelve (12) months preceding the claim, or $100, whichever is less.

7. Indemnification

You agree to indemnify, defend, and hold harmless Just Metrics, its operators, officers, directors, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or regulation
• Any content you submit or generate using the Service
• Any decisions you make based on information from the Service
• Any use of Service data for prohibited purposes (including FCRA violations)
• Any claim that you received "legal advice" from Just Metrics
• Any unauthorized scraping, data extraction, or redistribution of our data
• Any infringement of our intellectual property rights

8. User Responsibilities

Professional Responsibility

If you are a licensed attorney, you acknowledge that:

• You remain solely responsible for your professional obligations
• The Service does not replace your independent legal judgment
• You must comply with all applicable rules of professional conduct
• You are responsible for protecting client confidences and attorney work product

Data Entry Responsibility

You are responsible for:

• The accuracy of any data you enter into the Service
• Ensuring you have the right to enter case information
• Not entering information that violates any court order, protective order, or seal
• Anonymizing case information when appropriate
• Complying with ethical obligations regarding client confidentiality

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

9. Intellectual Property

Our Content

Just Metrics, our logo, and the Service are proprietary to us. All content, features, and functionality are owned by Just Metrics and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any case information you enter. By using the Service, you grant us a license to use, process, and analyze your data solely to provide the Service to you.

10. Privacy and Data Security

Your use of the Service is also governed by our Privacy Policy. While we implement reasonable security measures:

• We cannot guarantee absolute security of your data
• You should not enter highly sensitive or privileged information beyond what is necessary
• You are responsible for maintaining backups of critical information
• In the event of a data breach, we will notify you as required by law

11. Subscription and Payment Terms

Billing

• Subscriptions are billed monthly or annually as selected
• All fees are processed through Stripe, our payment processor
• Prices are subject to change with notice
• Refunds are provided at our sole discretion

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months or unused service

Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Use the Service for prohibited purposes
• Engage in fraudulent or illegal activity
• Fail to pay applicable fees

12. Modifications to Terms and Service

We may modify these Terms at any time by posting updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

We may also:

• Add, modify, or remove features from the Service
• Change pricing with reasonable notice
• Discontinue the Service entirely

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Just Metrics regarding the Service and supersede all prior agreements and understandings.
